Applies to: All current and future applications and services developed by Barclay Creek LLC (including but not limited to Reality Rank, Bowl Spinner, Go Pick Girl, Carryover Coach, and Wash Day)

1. Acceptance of Terms

By accessing or using any of our applications (“Apps”) or the website heyitsquay.com (the “Site”), you agree to these Terms and to our Privacy Policy. If you do not agree, you must not use the Apps or the Site.

2. Eligibility

The Apps are intended for individuals who are at least 18 years old and located within the United States. Use of the Apps outside the United States is at the user’s own risk and responsibility. We make no representations that the Apps are appropriate or lawful outside the United States, and may restrict or deactivate accounts found to be outside supported regions.

3. Accounts

Some Apps may require creation of a user account. Users are not required to provide real names. You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted under your account.

4. Acceptable Use

You agree not to:

Post or transmit unlawful, harmful, abusive, defamatory, obscene, or otherwise objectionable content.
Upload content that infringes any intellectual property or proprietary rights.
Copy, distribute, resell, or otherwise exploit the Apps or their contents for commercial purposes.
Attempt to reverse engineer, decompile, or otherwise interfere with the Apps.

Violation of these terms may result in suspension or termination of your account.

5. Intellectual Property

All content, features, and design elements in the Apps and Site are the property of Barclay Creek LLC or its service providers. You may not reproduce, republish, or use such materials without prior written permission.

6. User-Generated Content

You retain ownership of any content you submit through the Apps. By submitting content, you grant Barclay Creek LLC a non-exclusive, worldwide, royalty-free license to display, store, reproduce, and distribute such content as necessary to operate the Apps and to promote or share user content on related platforms (including websites, newsletters, and social media), with attribution where appropriate.

If you believe that content infringes your copyright, please contact privacy@heyitsquay.com to request removal.

7. Third-Party Services

The Apps use third-party providers, including but not limited to Supabase (database and authentication), Resend (email), Buy Me a Coffee (donations), and Google Analytics (usage tracking). Your use of these services is subject to their respective terms and policies.

8. Payments and Donations

The Apps do not currently include paid features. Voluntary donations are processed via Buy Me a Coffee and Stripe, subject to their terms and conditions. We reserve the right to introduce monetization features, including advertisements or subscriptions, in the future.

9. Notifications

Certain Apps may use push notifications to deliver reminders or updates. Notifications will only be sent with your consent, and you may disable them at any time in your device settings.

10. Termination

We may suspend or terminate your account at our discretion, including for violation of these Terms. Termination may result in loss of access to data or content. No refunds will be issued for donations or services.

11. Disclaimers

The Apps are provided on an “as is” and “as available” basis, without warranties of any kind. We do not warrant uninterrupted operation, error-free functionality, or specific outcomes.

12. Limitation of Liability

To the maximum extent permitted by law, Barclay Creek LLC shall not be liable for any indirect, incidental, or consequential damages arising out of or related to use of the Apps.

13. Indemnification

You agree to indemnify and hold harmless Barclay Creek LLC and its affiliates from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from your use of the Apps, your content, or your violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved exclusively in the state or federal courts located in Texas.

15. Changes to Terms

We may revise these Terms from time to time. Updated versions will be posted in-app or on the Site. Continued use of the Apps after changes are posted constitutes acceptance of the revised Terms.

16. General Provisions

Severability: If any provision is found invalid or unenforceable, the remaining provisions shall remain in effect.
No Waiver: Failure to enforce any provision shall not constitute a waiver of our rights.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Barclay Creek LLC regarding the Apps.
